
URGENT: NEW H-1B Visa for Entrepreneurs & Self-Employed

USCIS (United States Citizenship and Immigration Services) has expanded the use of the well-known H-1b non-immigrant visa to now include the entrepreneurs and start-ups seeking to move into the US. Previously the H-1b was only for established companies seeking to employ professional workers. Now, a newly created company that the proposed H-1b employee owns can act as the petitioner for the H-1b visa, assuming the petitioning entity has a real US presence and the offered employment is bona fide and provable as such. The H-1b visa quota remains in place so this expansion of the H-1b will generate even greater demand for one of the coveted annual 85,000 available visas per year (65,000 plus 20,000 for masters degree level job offers). There is a 14-day registration period that usually launches in March. We anticipate that this will occur again in March 2025.
To qualify any interested applicant should be able to demonstrate the following:

Have a university degree or the equivalent (equivalent usually means proving 12 years of valid work experience).

Have an existing job offer from a US company OR register your own company with a bona fide job offer (corporation such as an LLC) with a tax ID number and a physical office space in the US.

Valid passport & up-to-date CV.

An executive summary or business plan for your proposed business venture in the US.

You do not need a US tourist visa (B1-2).

Registration period closes March 24, 2025. Selection notice published March 31.
